Why this application is not approved: Not approved following a district privacy compliance review: the vendor's terms directly conflict with Florida Statute 1006.1494, FERPA. Florida Statute 1006.1494: The policy grants Newsela an extremely broad, perpetual, and sublicensable license to use 'User Content,' which explicitly includes 'Personal Data.' This broad license for commercial or non-commercial use, distribution, and creation of derivative works directly conflicts with FS1006's prohibitions on building student profiles for non-K-12 purposes, selling/renting covered information, and disclosing covered information beyond K-12 school purposes. FERPA: The broad, perpetual, and sublicensable license granted to Newsela for 'User Content,' which explicitly includes 'Personal Data,' directly conflicts with FERPA's requirements for maintaining the confidentiality of education records, limiting use to the contracted educational purpose, and restricting redisclosure. Such an open-ended right to use and distribute student data, including commercially, is incompatible with FERPA.
