Why this application is not approved: Not approved following a district privacy compliance review: the vendor's terms directly conflict with Florida Statute 1006.1494, F.A.C. 6A-1.09550, FERPA, PPRA, COPPA. Florida Statute 1006.1494: The policy explicitly states that it, and its third-party partners, use tracking technologies to show "interest-based advertisements." Florida Statute 1006.1494 prohibits targeted advertising based on covered student information. F.A.C. 6A-1.09550: The policy states information may be used for "Providing marketing and promotional materials" and "interest-based advertisements." These are not authorized educational purposes and directly violate the requirement that data be used only for the authorized educational purpose. FERPA: The policy describes uses for marketing, promotional materials, and interest-based advertising. These uses go beyond what would be considered a legitimate educational purpose and mean the vendor would not be acting as a "school official" under the direct control of the district, nor would use be limited to functions for which the school would use its own employees. PPRA: The policy explicitly states the use of personal information for "Providing marketing and promotional materials," "Customer retention, feedback, and reactivation programs," and "interest-based advertisements." This is a direct violation of PPRA's prohibition on collecting, disclosing, or using student personal information for marketing or selling purposes. COPPA: The policy contains a critical contradiction: it lists collecting "Parent / Guardian permission if under 13 years of age" but then states in the Children's Privacy section, "We do not target or knowingly collect personal information from individuals less than 13 years of age."
